The innocent exception rule applied in misrepresentation cases in immigration law. The applicable provision in IRPA is s. 40(1)(a). The Minister of IRCC announced recently that foreign nationals who have been in possession of a post grad work permit but their document is expiring soon and they have not been able to convert their status to PR are going to be given another 18 months of time on a newly extended work permit option.
